Terms of Use

These Terms of Use ("Terms") govern access to and use of Plans Release at plansrelease.com and related services (the "Service"). By using the Service, you agree to these Terms.

What Plans Release is

Plans Release is software that helps professional design firms upload completed plans, notify clients, collect client payment through Stripe, and release final files after payment is confirmed. Plans Release is not a bank, lender, escrow agent, payment guarantor, law firm, or debt collector.

Accounts

You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. New accounts may include a limited free trial; continued use after the trial requires an active paid subscription unless otherwise arranged.

Professional responsibilities

You are solely responsible for the accuracy, completeness, legality, and professional quality of plans and other files you upload; for amounts you charge clients; for your client relationships; and for complying with licensing, ethics, and legal obligations in your jurisdiction. Plans Release does not practice architecture, engineering, surveying, or law on your behalf.

Client payments

Client payments for projects are processed by Stripe to your connected Stripe account when configured. Plans Release does not take a percentage of those professional project fees. Stripe fees and payout timing are governed by Stripe. Plans Release does not guarantee that a client will complete payment.

Platform subscription

Access to paid platform features may require an annual subscription billed through Stripe. Subscription terms, renewals, and cancellations are handled through Stripe billing tools where available.

Acceptable use

You agree not to:

• Misuse the Service or attempt unauthorized access.
• Upload malware, infringing content, or content you are not authorized to distribute.
• Use the Service to harass, defraud, or unlawfully collect from others.
• Reverse engineer or disrupt the Service except where prohibited restrictions are not allowed by law.

File retention

Uploaded files may be deleted after configured retention periods, unpaid windows, or account actions. You should keep your own independent copies of professional work product.

Intellectual property

The Service, branding, and software are owned by Plans Release or its licensors. You retain ownership of the plan files and content you upload, and you grant Plans Release a limited license to host, process, and deliver that content solely to operate the Service for you and your clients.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLANS RELEASE DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT PAYMENT OR DELIVERY OUTCOMES WILL MEET YOUR EXPECTATIONS.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLANS RELEASE AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID TO PLANS RELEASE FOR THE PLATFORM SUBSCRIPTION IN THE TWELVE MONTHS BEFORE THE CLAIM.

Indemnity

You agree to defend and indemnify Plans Release and its operators against claims arising from your content, your client engagements, your misuse of the Service, or your violation of these Terms or applicable law.

Termination

We may suspend or terminate access if you violate these Terms or if needed to protect the Service or others. You may stop using the Service at any time. Provisions that should survive termination will survive.

Changes

We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use after an update constitutes acceptance of the revised Terms.
